Summary

The focus of this presentation will be on practical resources related to domain names for trademark professionals. It will show various useful tips, tools, databases and forms with the aim of enhancing practitioners’ ability to seek, analyze and act upon relevant information, and their understanding of inner aspects of domain names. This webinar will include explanations on items such as:

  • Navigating IANA Root Zone database and WIPO ccTLD database;
  • Uncovering and extracting Whois data with reverse, bulk, history, wildcard and typo searches;
  • Filing inaccuracy or abuse complaints and disclosure requests with registry operators, webhosts and privacy providers;
  • Relying on anonymous offers, marketplaces, deletion cycle, back order and escrow service providers and reported domain sales to purchase existing domain names;
  • Monitoring use and control through automated change detection;
  • Using authorization codes to transfer domain names;
  • Securing domain names beyond passwords: registrar, registry and account locks; and
  • Considering the Uniform Rapid Suspension System as an alternative to UDRP.

Biography

Marcel Naud is a lawyer and trademark agent at the Canadian IP boutique firm ROBIC. As part of his practice, he regularly handles arbitration proceedings relating to domain names and advises clients of the firm in respect of the strategic management of their domain name portfolios.

He became an expert on legal issues related to digitization of business processes, services, works and other products as well as the protection and enforcement of trademarks and copyright on the Internet. He often negotiates, drafts and reviews agreements pertaining to the development, use and commercialization of software products, SaaS and websites. He also provides opinions and recommendations on various IP or IT-related issues such as compliance with open source licenses, obligations of merchants in distance contracts, protection of confidential or personal information in online environments and complex copyright and trademark questions.

Marcel Naud is a member of the Intellectual Property Institute of Canada, its Internet Committee and its Information, Communication & Technology Committee as well as the Editorial Board of the Canadian Intellectual Property Review (CIPR), a double-blind peer reviewed journal. He is frequently asked by various organizations to act as a speaker or moderator on forefront topics regarding legal developments in intellectual property.
