This webinar aims to provide a deeper sense on the developments of prosecution for pharmaceutical patent applications in Latin America, with particular reference to Brazil, Mexico, and the Andean Community (Colombia, Peru, Ecuador and Bolivia).
With a population of more than 200 million people and being the 6th largest pharmaceutical market in the world, Brazil is a top priority for patent investments in the pharma industry. Applicants, however, face several obstacles when prosecuting in Brazil, especially in cases involving pharmaceutical products and processes.
Although the Andean Community countries share the same IP Law, Patent Offices in each country (Colombia, Bolivia, Ecuador and Peru) have different prosecution speeds and even different standards for pharmaceutical patents. The Colombian Patent Office is the fastest Office in the Latin American region and has favorable grant rates for this type of industry.
Finally, Mexico, also a top giant in Latin America, is currently adapting its procedures to the USMCA signed on 2018 with the United States and Canada, which will certainly impact its whole patent system, and consequently how these applications are handled in the near future.
